AN ACT
repealing Section 15-249.08, Arizona Revised Statutes; appropriating monies; relating to the department of education.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Repeal
Section 15-249.08, Arizona Revised Statutes, is repealed.
Sec. 2. Appropriation; department of education; title I schools; distribution; definition
A. The sum of $68,600,000 is appropriated from the state general fund in fiscal year 2021-2022 to the department of education to distribute to school districts and charter schools that receive federal title I monies.
B. The department of education shall distribute the monies appropriated under subsection A of this section as follows:
1. Calculate the total amount of federal title I monies received by all school districts and charter schools in this state during the 2019-2020 fiscal year.
2. Calculate the amount of federal title I monies received by each school district and charter school in this state during the 2019-2020 fiscal year.
3. For each school district or charter school, determine the percentage of the total amount of federal title I monies received by all school districts and charter schools in this state during the 2019-2020 fiscal year that the school district or charter school received by dividing the amount calculated pursuant to paragraph 2 of this subsection for that school district or charter school by the amount calculated pursuant to paragraph 1 of this subsection.
4. Each school district or charter school shall receive a percentage of the monies appropriated in subsection A of this section that is equal to the percentage calculated in paragraph 3 of this subsection.
C. For the purpose of this section, "federal title I monies" means monies received under title I of the elementary and secondary education act of 1965 (P.L. 89–10; 79 Stat. 27), as reauthorized.
Sec. 3. Intent
The Legislature intends that the $68,600,000 appropriation in the baseline budget dedicated to results-based funding instead be redirected to school districts and charter schools that received federal title I monies.
