AN ACT
Amending title 3, chapter 2, article 5, Arizona Revised Statutes, by adding Section 3-342; relating to pesticides.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 3, chapter 2, article 5, Arizona Revised Statutes, is amended by adding section 3-342, to read:
3-342. Prohibition; glyphosate; residential property; civil penalties; definition
A. It is unlawful for a person to apply glyphosate on residential ground cover beds.
B. A person who sells a product that contains glyphosate at retail shall maintain in the immediate vicinity of the product a sign stating, in twenty-four-point type, substantially the following: "state law prohibits the application of glyphosate on residential property."
C. A person who knowingly violates subsection A of this section is subject to a civil penalty of not more than $200 for each violation.
D. A person who knowingly violates subsection B of this section is subject to a civil penalty of $500.
E. For the purposes of this section, "residential ground cover beds" means any turfgrass, flower bed, gravel or bare area located on a residential property.
Sec. 2. Effective date
This act is effective from and after December 31, 2021.
