AN ACT

 

amending section 23-780, Arizona Revised Statutes; relating to employment security.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Section 23-780, Arizona Revised Statutes, is amended to read:

START_STATUTE23-780. Duration and amount of benefits; rules; definition

A. An otherwise eligible individual shall be is entitled during a benefit year to a total amount of benefits equal to: twenty-six

1. If this state's average unemployment rate is at or below five and one-half percent, twelve times his the individual's weekly benefit amount. , but shall

2. If this state's average unemployment rate is above five and one-half percent but not more than nine percent, twelve times the individual's weekly benefit amount plus one additional week of benefits for each one-half percent increment in this state's average unemployment rate above five and one-half percent.

3. If this state's average unemployment rate is above nine percent, twenty-six times the individual's weekly benefit amount.

B. Notwithstanding subsection A of this section, an individual may not receive more than one third one-third of his the individual's base period earnings in such a benefit year.

C. The department of economic security may adopt rules to carry out this section.

D. For the purposes of this section, "this state's average unemployment rate" means the average of the three months for the most recent third calendar year quarter of the seasonally adjusted unemployment rates as published by the office of economic opportunity. END_STATUTE

Sec. 2. Effective date

This act is effective from and after December 31, 2021.

Sec. 3. Short title

This act may be cited as the "Unemployment Insurance Sustainability Act of 2021".
