HB 2027: leaving accident scene; private property

Overview
Increases the penalty of a person who leaves the scene of an accident or fails to inform the property owner of the accident to a class 1 misdemeanor. Clarifies these penalties apply to accidents on public or private property.
History
A person involved in a vehicular accident resulting in the injury or death of another person, or damage to a vehicle attended to or driven by another person, is required to comply with the following requirements:
1) Immediately stop at the scene of the accident or as close to the accident scene as possible;
2) Remain at the scene until the driver has fulfilled reporting and notification requirements;
3) Provide the driver's name, address and vehicle registration number to the other party;
4) Show the driver's driver license to the other party, if requested; and
5) Provide reasonable assistance to a person injured in the accident.
Any person who does not comply with the above requirements is guilty of a class 2 or 3 misdemeanor. (A.R.S. §§ 28-662, 28-663)
Provisions
1. Clarifies that individuals involved in vehicular accidents on public or private property resulting in the injury or death of a person may not leave the scene of the accident until all reporting or notification requirements have been met. (Sec. 1)
2. Clarifies that individuals involved in vehicular accidents on public or private property resulting in damage to a vehicle driven or attended by another person may not leave the scene of the accident until all reporting or notification requirements have been met. (Sec. 2)
3. Clarifies that individuals involved in vehicular accidents on public or private property resulting in the injury or death of a person or damage to another vehicle driven or attended by another person may not leave the scene of the accident until all reporting or notification requirements have been met. (Sec. 3)
4. Clarifies that individuals involved in vehicular accidents on public or private property resulting in damage to an unattended vehicle may not leave the scene of the accident until all reporting or notification requirements have been met. (Sec. 4)
5. Increases the penalty to a class 1 misdemeanor for a person who leaves the scene of a vehicular accident before fulfilling all reporting or notification requirements. (Sec. 2, 3, 4, 5)
