HB 2054: voter registration database; death records

Overview

Requires the Secretary of State (SOS) to compare the death records with the statewide voter registration database.

History

Current statute requires the Arizona Department of Health Services (DHS) to transmit monthly to the SOS, a record of death of every Arizona resident that is reported to DHS. In addition, DHS must annually provide to the SOS a record of all deaths of Arizona residents from the statewide electronic death registration system. Both records must include:

            1) The name of the decedent;

            2) The decedent's date of birth and death; and

            3) The decedent's father's name or mother's maiden name.

The SOS is instructed to use the record, distributed by DHS monthly, for the sole purpose of cancelling the names of deceased persons from the Statewide Voter Registration Database (Register). Statute also permits the SOS to compare the annual records of deaths delivered by DHS with the Register.

The name of each deceased person must promptly be canceled from the Register and the SOS must notify the appropriate county recorder (Recorder). Once the Recorder is notified, they must cancel the name of the person from the Register (A.R.S. § 16-165).
