Overview

Requires law enforcement agencies to report annually to the national use-of-force data collection on use-of-force incidents and outlines requirements for data collection.

History

The National Use of Force Data Collection was created by the FBI in 2015.  The data collection is a partnership with law enforcement agencies (Agencies) to provide nationwide statistics on law enforcement use-of-force incidents.  Participation in the data collection is open to all federal, state, local, and tribal Agencies.  Participation is voluntary.  The FBI began collecting the data from Agencies on January 1, 2019 and includes: National-level statistics on law enforcement use of force incidents and basic information on the circumstances, subjects, and officers involved.  The most recent data is available on the FBI’s Crime Data Explorer website.

Provisions

1. Requires law enforcement agencies to report data annually to the national use-of-force data collection on use-of-force incidents involving public officers. (Sec. 1)

2. Requires law enforcement agencies to report data annually on use-of-force incidents involving public officers to the Arizona Criminal Justice Commission (ACJC). (Sec. 1)

3. Mandates by July 1, 2022, ACJC to develop collection standards and reporting guidelines on use-of-force incident data. (Sec. 1)

4. Clarifies use-of-force data collected and reported to ACJC or for national use-of-force data collection is public record. (Sec. 1)

5. Mandates by January 1, 2025, ACJC to complete a publicly-available comprehensive analysis of law enforcement agency use-of-force rates and update this report every five years. (Sec. 1)

6. Defines law enforcement agency, national use-of-force data collection, public officer and use-of-force incident. (Sec. 1)

7. Contains a delayed effective date of January 1, 2022. (Sec. 2)

Amendment

Committee on Criminal Justice Reform

1. Changes the term public officer to law enforcement officer.

2. Specifies the annual reports are required each January, beginning January 1, 2023.

3. Defines serious physical injury.
