HB 2182: rapid DNA testing; appropriation

Overview
Requires the director of the Department of Public Safety (DPS) to adopt rules for administering rapid DNA testing of crime scene DNA samples. Appropriates $1,200,000 and 3 full-time employee (FTE) positions from state General Fund (GF) in FY 2022 to DPS.
History
Rapid DNA allows the multiple DNA analysis steps on a single sample to be performed quickly using one instrument. This process typically takes less than two hours and these DNA samples may include blood and saliva.
DPS is responsible for creating and coordinating services for use by local law enforcement agencies in protecting the public safety. Currently, DPS is required to formulate plans with a view to establish modern services for prevention of crime, apprehension of violators, training of law enforcement personnel and the promotion of public safety (A.R.S § 41-1711).
Provisions
1. Requires the DPS director to adopt rules for administering rapid DNA testing of crime scene DNA samples, including:
a) Procedures for approving rapid DNA testing devices;
b) Procedures for ensuring the accuracy of results obtained from rapid DNA testing devices;
c) Qualifications for individuals who conduct rapid DNA testing; and
d) Qualifications for individuals who instruct others on administering rapid DNA testing. (Sec 1)
2. Appropriates $1,200,000 and 3 FTE positions from state GF in FY 2022 to DPS to:
a) Purchase and deploy four rapid DNA testing devices throughout the state; and
b) Train county sheriff's personnel on properly using the rapid DNA testing devices. (Sec. 2)
3. Requires the DPS director to submit a report to the chairpersons of the judiciary committee of the House of Representatives and the State Senate or their successor committees by October 15, 2021, January 15, 2022, April 15, 2022 and July 15, 2022, containing at least the following information:
a) The number of rapid DNA tests performed by DPS and the county sheriffs;
b) The number of criminal suspects identified or matched by rapid DNA testing to the combined DNA index system; and
c) The total number and types of crimes identified or matched by rapid DNA testing. (Sec. 2)
