Overview

Allows an affiliate of a nonprofit entity to be issued a special event license provided certain requirements are met.

History

The Department of Liquor Licenses and Control (Department), which consists of the State Liquor Board and the Office of the Director (Director) of the Department regulates the manufacture, distribution and sale of liquor in this state through the issuance of 21 license types or series.

Pursuant to A.R.S. § 4-203.02, the Director may issue a temporary special event license which authorizes a licensee on-sale or off-sale privileges. The Director may only issue a special event license to a: 1) government entity; 2) political party or campaign committee supporting a candidate for public office or a ballot measure; or 3) 501(c) nonprofit entity.  An applicant for a special event license may contract with a special event contractor for assistance in selling and serving spirituous liquor at the special event.

a)   The affiliate provides a letter from the Internal Revenue Service that the parent organization is a 501(c)(4) nonprofit entity;

b)   The proceeds of the event are for a charitable or nonprofit purpose;

c)   The affiliate provides a letter or a copy of a charter from the parent organization that recognizes the affiliate as a subordinate; and

d)   The affiliate or its members have not previously violated Alcoholic Beverages statutes, local requirements for special events or any fire code.
