Overview

Classifies a commercial motor vehicle safety violation by a driver as a civil traffic violation that is subject to a civil penalty of up to $500.

History

A motor carrier, shipper or manufacturer who operates or causes to be operated a commercial motor vehicle in violation of or knowingly violates motor carrier safety requirements is guilty of:

1)   A class 2 misdemeanor (4 months/up to $750 for persons or $10,000 for enterprises) for an initial violation;

2)   A class 1 misdemeanor (6 months/up to $2500 for persons or $20,000 enterprises) for a second violation; and

3)   A class 6 felony (1 year/up to $150,000 for persons or $1,000,000 for enterprises) for any subsequent violation. (A.R.S. § 28-5240).

A violation of motor carrier equipment requirements is a civil traffic violation unless the violation requires issuance of an out-of-service order (A.R.S. § 28-5245).
