Overview
Expands the ability in which a detention officer can arrest a person pursuant to an existing warrant.
History
A detention officer who is acting in the officer’s official capacity at a jail facility at which the detention officer is employed and pursuant to a warrant may arrest a person who is already incarcerated in that jail facility or who surrenders to that jail facility. Detention officer is a person other than an elected official who is employed by a county, city or town and who is responsible for the supervision, protection, care, custody or control of inmates in a county or municipal correctional institution (A.R.S. § 13-3907).
Provisions
1. Allows a detention officer to arrest a person pursuant to an existing warrant if the person is either:
a) Already incarcerated in or surrenders to a jail facility where the detention officer is employed;
b) At a hospital where the detention officer is assigned, and the person being arrested is under law enforcement supervision or custody while in the hospital;
c) At a superior, justice or municipal court where the detention officer is assigned; and
d) Within a jail facility as a visitor and the person is found to have an outstanding warrant. (Sec. 1)
2. Enables a detention officer acting in official capacity to take custody of a person whom a judicial officer remands into custody during a court proceeding. (Sec. 1)
