Overview

Establishes requirements to become a member of a civilian review board.

History

A civilian review board is an entity external to the police department’s internal affairs, and consists of citizens from outside the department, appointed by the mayor or other senior government official. It is generally charged with the duty of reviewing complaints and making recommendations as to disciplinary action after the police department has complete its own investigation and made a disciplinary recommendation.

Provisions

1.   ☐ Prop 105 (45 votes)	     ☐ Prop 108 (40 votes)      ☐ Emergency (40 votes)	☐ Fiscal NoteRequires a person, prior to becoming a member of a civilian review board that reviews the actions of peace officers in Arizona, to complete the following:

a)   A community college police academy; and

b)   At least 20 hours of virtual law enforcement training. (Sec. 1)

2.   Defines civilian review board as a committee that is comprised entirely or partially of civilian appointees and:

a)   Receives community complaints about the actions taken by employees of a state or local law enforcement agency;

b)   Reviews, monitors, audits or participates in internal investigations of employees of state or local law enforcement agencies;

c)   Recommends policy changes or disciplinary measures to state or local law enforcement agencies;

d)   Issues reports or information about actions taken by an employee of a state or local law enforcement; and

e)   Engages in community outreach efforts regarding actions taken by a state or local law enforcement agency. (Sec. 1)

Amendments

Committee on Military Affairs & Public Safety

1.   Requires a person, prior to becoming a member of a civilian review board, to complete either a community college police academy or 80 hours of Arizona Peace Officer Standards and Training (AZPOST) board certified training.

2.   Outlines the subject areas that are included in the 80 hours of AZPOST board certified training.

3.   Requires members that are currently sitting on civilian review boards to complete the required training within one year of the effective date of the bill.
