Overview

Establishes laser possession at a riot or unlawful assembly as a class 1 misdemeanor.

History

A riot occurs when three or more people acting together recklessly uses or threatens force or violence and disturbs the public peace (A.R.S. § 13-2903). Unlawful assembly occurs when three or more people assemble with the intent to engage in a riot, or being present at a riot and refusing to obey an official order to disperse (A.R.S. § 13-2902).

An affirmative defense is a defense offered by the accused to excuse a criminal act (A.R.S. § 13-103).
