Overview

Includes time spent on electronic monitoring before sentencing as part of time spent in custody.

History

A prison sentence begins at sentencing if the defendant is already in custody, or when the defendant is taken into custody after sentencing. All time spent in custody until the prisoner is sentenced to imprisonment is credited against the sentence (A.R.S. § 13-712).

For bailable offenses, the defendant may be released from custody pending trial. For certain felony sexual offenses, when the defendant is on bail, a judicial officer must provide for electronic monitoring of the defendant and a condition prohibiting the defendant from having any contact with the victim (A.R.S. § 13-3967).
