HB 2716: licensing; building permits; temporary permits

Overview
Establishes an expedited process for issuance of a building permits.
History
A.R.S. § 9-835 requires a municipality to establish a time frame during which the municipality will grant or deny a license required to satisfy any new ordinance or code. This time frame must separately state the administrative completeness review time frame and the substantive review time frame and it must be posted on the municipality’s website. Municipalities must prioritize the establishment of time frames for those licenses that have the greatest impact on the public. Statute specifies the details that must be considered when establishing time frames.
Provisions
Building Permits; Standard Plans; Issuance; Temporary Permits
1. Requires the municipality that requires a building permit for construction of single-family dwellings to issue the permit within seven calendar days of submission of an administratively complete application.
a) Details application requirements for permits that include:
i. Approved construction documents for the dwelling.
ii. Approved water service for fire suppression in the community.
2. Mandates the issuance of a temporary building permit if the municipality fails to issue the building permit within seven calendar days.
a) Allows construction to commence with issuance of a temporary permit.
b) Requires the municipality to issue the building permit as soon as practicable.
3. Requires the municipality that has not approved water service for fire suppression in the subdivision where the dwelling will be constructed to approve a permit pending water approval and issue the permit as soon as is practicable.
4. Prohibits an applicant, unless otherwise authorized, from commencing construction until water service has been approved and the permit is issued.
5. Specifies construction may commence immediately upon issuance of the building permit.
6. Prohibits the municipality from issuing a fine, penalty or other action in response to construction under a permit or temporary permit.
7. Clarifies that the municipality is not prohibited from:
a) Offering expedited permit applications.
b) Adopting reasonable regulations for issuing a certificate of occupancy.
8. Stipulates that the municipality's substantive review of an application conforms to current requirements.
9. Defines building permit, certificate of occupancy and construction documents.
Miscellaneous
10. Prohibits municipalities from prioritizing applications for a license as required by an ordinance over other applications when it comes to review. (Sec. 1)
