HCR 2026: state of emergency; termination; referral

Overview
States that a state of emergency terminates after 14 days, unless a special session of the Legislature is called by the Governor.
History
Current statute states that during a state of emergency the Governor has complete authority over all agencies of the state government and the right to exercise all police power vested in the state constitution. The powers granted to the Governor terminates when the state of emergency has been terminated by proclamation of the Governor or by concurrent resolution of the Legislature (A.R.S. § 26-303).
Provisions
1. States that a state of emergency terminates 14 days after the date that the emergency is proclaimed, unless on or before the 14th day, the Governor calls a special session of the Legislature to legislate on subjects relating to the state of emergency. (Sec. 1)
2. Directs the Secretary of State to submit the proposition to the voters in the next general election. (Sec. 1)
