SB 1431: flood control districts; advisory board

Overview
Mandates, instead of permits, that the board of directors of a county flood control district (flood district) must appoint a citizens' flood control advisory board (citizen board). Modifies the number and appointment of members for a citizen board.
History
A flood district is a political taxing subdivision established to: 1) construct and operate flood control works and storm drainage facilities; 2) regulate floodplains; 3) construct and maintain artificial groundwater recharge facilities; and 4) implement related flood control measures (A.R.S. § 48-3603). A citizen board may be established by a flood district to provide advice at the request of the flood district. A citizen board is to study flood control, floodplain regulation, water drainage and water conservation. At the request of the flood district, the citizen board is to provide informational reports and non-binding recommendations to the flood district (A.R.S. § 48-3611).
Provisions
1. Mandates, instead of permits, that the board of directors of a flood district must appoint citizen board. (Sec. 1)
2. Changes the size of the citizen board from seven to six members; five are to be voting members appointed by the flood district board of directors, one is an advisory member. (Sec. 1)
3. States that each member of a flood district's board of directors is to appoint one of the five voting members of the citizen board; at least three of these appointees must reside in the same city as the director who appoints them. (Sec. 1)
4. Prohibits city or town employees from sitting on a citizen board. (Sec. 1)
5. States that the advisory member of the citizen board is to be:
a) the chief engineer;
b) a manager of a major irrigation or agricultural improvement district; or
c) a representative chosen by them. (Sec. 1)
6. Directs the citizen board to meet at least quarterly. (Sec. 1)
7. Mandates that the citizen board is to have access to the flood district's budget information and to make recommendations regarding the budget. (Sec. 1)
8. Requires the citizen board to meet with the flood district board of directors at least annually in a public meeting. (Sec. 1)
9. States that current members of a citizen board may continue to serve until the end of their normal terms. (Sec. 3)
10. Makes technical changes. (Sec. 1, 2)
