SB 1719: state emergency council; membership; procedures

Overview

Adds members to the State Emergency Council (Council) and requires the Governor to convene the Council within a certain time period after proclaiming a statewide state of emergency.

History

Current statute establishes the Council that consists of 14 members that include, but are not limited to, the Governor, the Secretary of State, the President of the Senate and the Speaker of the House of Representatives both of whom are advisory members.  The Council is charged with making recommendations for policies and procedures to the Governor and issuing a state of emergency proclamation if the Governor is inaccessible.  Additionally, the Council is required to monitor each emergency declared and the activities and response of the division to the emergency.  Finally, the Council is tasked with recommending to the Governor or Legislature based on the submitted reports by the auditor that the emergency conditions have stabilized and the emergency is substantially contained (A.R.S. § 26-304).

Provisions

1.   Adds the Majority Leader, Majority Whip, Minority Leader, Assistant Minority Leader and Minority Whips of the Senate and the House of Representatives as advisory members to the Council. (Sec. 1)

2.   Specifies that if the Governor is inaccessible, the issuance of a state of emergency proclamation must be done at a meeting of the Council where at least three of the members and at least one of whom is an elected official, approve the action. (Sec. 1)

3.   Directs the Governor to convene the Council on or before the 14th day after proclaiming a statewide state of emergency. (Sec. 1)

4.   Stipulates that the Governor must continue to convene the Council at least once every 14 days for the duration of the statewide state of emergency. (Sec. 1)

5.   States that the statewide state of emergency terminates if the Governor does not convene the Council within the specified time period. (Sec. 1)

6.   Contains an applicability clause that applies this legislation to a statewide state of emergency proclaimed on or after March 1, 2020. (Sec. 2)

7.   Requires the Governor to convene the Council on or before the 14th day after the effective date of this legislation and at least once every 14 days for the duration of the statewide state of emergency. (Sec. 2)
