Overview
Modifies the number of days a condominium or planned community association (HOA) may prohibit the display of political signs and extends the time period a city, town or county to prohibit the removal, alteration, defacing or covering of political signs.
History
Arizona cities, towns and counties are prohibited from removing, altering, defacing or covering any political signs if certain conditions are met, including if the sign supports or opposes a candidate for public office or a ballot measure and the sign contains the name and number or website of a candidate or campaign committee contact person. This only applies during the period commencing 60 days before and ending 15 days after the primary election (A.R.S. § 16-1019).
HOAs are restricted from prohibiting indoor and outdoor displays of political signs by an owner by placement of a sign on that owner's property or by an association member on that member's property. However, an HOA may prohibit the display of political signs that are earlier than 71 days before the day of an election and later than 3 days after the day of an election day (A.R.S. §§ 33-1261 and 33-1808).
Provisions
1. Extends the time period for when a city, town or county may not remove, deface, alter or cover any political sign from 60 to 71 days before a primary election. (Sec. 1)
2. Allows an HOA to prohibit the display of political signs:
a) Earlier than 71 days before the day of a primary election;
b) Later than 15 days after the day of the general election; and
c) Later than 15 days after the primary election for a sign for a candidate in the primary election that does not advance to the general election. (Sec. 2, 3)
