Summary of the Strike-Everything Amendment to SCR 1010

Overview

Calls for a convention of the states (Convention) to confer on actions by the federal government, it's officers and agencies that impair the constitutional and traditional rights of American citizens.

History

Article V of the U.S. Constitution authorizes Congress to call a convention for proposing amendments to the Constitution upon application of two-thirds of several state legislatures. Proposed amendments to the Constitution can be ratified either by the Legislatures of three-fourths of the states or conventions in three-fourths of the states (U.S. Constitution, Article V).

Provisions

1.   Specifies that a Convention be called to confer on actions by the federal government or by officers or agencies that impair or threaten to impair the constitutional and traditional rights of Americans and to recommend corrective actions.

2.   Calls a Convention, consisting of commissioners chosen by the state Legislature or majority leadership of each legislative chamber as outlined.

3.   Empowers the Convention to recommend to represented states one or more formal institutional structures for the aforementioned purpose.

5.   Prescribes that the Arizona Legislature urges each legislative assembly to appoint commissioners to attend the Convention, cooperate and provide further assistance.

6.   Directs the Secretary of State to transmit a copy of this resolution to the presiding officer of each legislative body in the several states.

1.   Names the Convention the Phoenix Convention on Constitutional Liberties and Self-Government.

2.   Allows the Convention to discuss issues regarding the right of people to self-govern and elect representatives through secure and transparent election processes.

3.   Provides certain principles that the Arizona Legislature recommends the Convention to follow.

4.   Creates a six member Arizona Constitutional Liberties and Self-Government Planning Convention Committee (Planning Committee) and outlines committee membership, it's powers and duties.

5.   Specifies the process for the Planning Committee to call a meeting.
