sale of state lands; notice
Purpose
Requires a notice for the sale of state land to be posted on the Arizona State Land Department's (ASLD's) website.
Background
The Arizona Constitution requires all state lands expressly transferred to the state by the federal government in the Enabling Act and all lands acquired by the state to be held in trust for specified beneficiaries (Ariz. Const. art. 10 § 1). ASLD is the trustee of Arizona's trust land and administers the state trust land and its resources.
Statute prescribes a process and requirements for the sale of state trust land at auction. Current law requires the notice for the sale of state lands to be circulated for a minimum of 10 successive weeks in a newspaper of general circulation that is regularly published nearest to the location of the lands to be sold, and in a newspaper of general circulation at the state capital (A.R.S. § 37-231).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Requires the notice for sales of state lands to be posted on ASLD's website.
2. Makes technical changes.
3. Becomes effective on the general effective date.
Amendments Adopted by Committee of the Whole
· Restores current law that requires the notice of sale of state lands to be published once a week for 10 successive weeks in a newspaper of general circulation published regularly at the state capital and in a newspaper that is regularly published nearest the location of the lands being sold.
