Purpose

Permits a school district governing board (governing board) to provide food and beverages at school district events.

Background

The Arizona Department of Education (ADE) develops minimum nutrition standards that meet federal guidelines and regulations for food and beverages sold or served at elementary school, middle school and junior high schools during the normal school day. ADE is authorized to develop minimum nutrition standards that are more stringent than the federal guidelines (A.R.S. § 15-242).

Food and beverages sold or served at schools or at school-sponsored events during the normal school day must meet ADE's nutrition standards. Statute does not prohibit or limit the sale or distribution of: 1) any food or beverage item through fundraising activities of students, teachers or educational groups when the items are intended for sale off school grounds; or 2) any food or beverage items for teachers, administrators or other adults in a faculty lounge or other circumstances where the sale or distribution is limited (A.R.S. § 15-242).

There is no anticipated fiscal impact to the state General Fund associated with this legislation.

Provisions

1.   Allows governing boards, subject to ADE policies, to provide food and beverages at school district events, including school functions and trainings.

2.   Makes technical changes.

3.   Becomes effective on the general effective date.
