Purpose
Requires the Secretary of State (SOS), by December 31, 2023, to operate and maintain the online voter registration system in conjunction with a committee of county recorders.
Background
Any person who is applying for a driver license or renewal and is otherwise qualified to register to vote must be allowed to register to vote at the same time and place by providing required voter registration information. Upon completion of a form that contains statutorily prescribed requirements for proper registration and on receipt of that form by a county recorder from the Arizona Department of Transportation (ADOT), the applicant is presumed to be properly registered to vote.
The Director of ADOT (Director) and the SOS must consult every two years regarding voter registration at driver license offices. The Director and the SOS must, after consultation with all county recorders, adopt rules to implement a system allowing driver license applicants to register to vote at the same time and place as they apply for driver licenses. The rules must: 1) bring the license application and voter registration application forms into substantial conformity; 2) allow the transfer of driver license applications and voter registration information from ADOT to the voter registration rolls; 3) respect all rules and Arizona laws concerning the confidentiality of driver license application information; and 4) provide for the manual or electronic generation and transmittal of voter registrations and for the electronic generation of changes in voter registration information in conformity with the confidentiality requirements of the National Voter Registration Act of 1993. ADOT must return or mail completed registrations to the county recorder of the county in which the applicant resides within five days of receipt of a completed registration (A.R.S. § 16-112).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Requires the SOS, by December 31, 2023, to operate and maintain the online voter registration system in conjunction with a committee of county recorders that is selected by a statewide county recorder membership group.
2. Stipulates that if the SOS and committee of county recorders contract with a third party for some or all of the operation and maintenance of the voter registration system, the contract must require that the website address for access to the system use the top-level domain .gov or .vote.
3. Makes technical and conforming changes.
4. Becomes effective on the general effective date.
Governor's Veto Message
The Governor indicates in his veto message that H.B. 2360 makes wholesale changes to the ownership and operation of the online voter registration that is unnecessary and removes the checks and balances that have served the development and administration of the system.
