ARIZONA STATE SENATE

civilian review board members; training
Purpose
Requires members of a peace officer civilian review board to complete specified training before becoming a board member.
Background
Statute defines peace officer to include county sheriffs, constables, marshals, police officers of cities and towns, commissioned personnel of the Department of Public Safety, personnel who are employed by the Arizona Department of Corrections and the Arizona Department of Juvenile Corrections and who have received Arizona Peace Officer Standards and Training Board (AZPOST Board) certification, peace officers who are appointed by a multicounty water conservation district and who are AZPOST Board certified, police officers who are appointed by community college district governing boards and who are AZPOST Board certified, police officers who are appointed by the Arizona Board of Regents and who are AZPOST Board certified, police officers who are appointed by the governing body of a public airport and who are AZPOST Board certified, peace officers who are appointed by a private postsecondary education institution and who are AZPOST Board certified and special agents from the Attorney General's Office, or of a county attorney, and who are AZPOST Board certified (A.R.S. § 1-215).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Requires a person, before becoming a member of a civilian review board that reviews the actions of peace officers, to satisfactorily complete:
a) a community college police academy; or
b) 80 hours of AZPOST-Board-certified training in the subjects of:
i. Arizona law on use of force justification;
ii. dynamics of use of force encounters;
iii. body-worn camera capabilities and limitations;
iv. in custody deaths;
v. criminal and administrative investigations and representative due process; and
vi. 20 hours of simulated event law enforcement training that counts toward the 80-hour requirement.
2. Requires members currently serving on a civilian review board to complete the required training within one year of the general effective date.
3. Defines civilian review board as a committee that is comprised entirely or partially of civilian appointees and that:
a) receives community complaints about the actions taken by employees of a state or local law enforcement agency;
b) reviews, monitors, audits or participates in internal investigations of employees of state or local law enforcement agencies;
c) recommends policy changes or disciplinary measures to state or local law enforcement agencies regarding actions taken by an employee of the agency;
d) issues reports or information about actions taken by an employee of a state or local law enforcement agency; or
e) engages in community outreach efforts regarding actions taken by a state or local law enforcement agency.
4. Becomes effective on the general effective date.
