Purpose
Specifies that a person commits residential picketing, regardless of whether the person has an intent to harass, annoy or alarm another person, if a reasonable person would find the actions harassing, annoying or alarming.
Background
A person commits residential picketing if the person intentionally engages in picketing or otherwise demonstrates before or about a residence or dwelling place of an individual, other than a residence or dwelling place also used as the principal place of business of the individual, with intent to harass, annoy or alarm another person. A person who commits residential picketing is guilty of a class 3 misdemeanor (A.R.S. § 13-2909).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Specifies that a person commits residential picketing, regardless of whether the person has an intent to harass, annoy or alarm another person, if a reasonable person would find the actions harassing, annoying or alarming.
2. Makes technical changes.
3. Becomes effective on the general effective date.
