motor vehicle transactions; advertised vehicle price
Purpose
Requires a motor vehicle dealer to clearly and conspicuously disclose in the advertisement for a motor vehicle that a document fee will be charged for the motor vehicle transaction.
Background
Current statute states a motor vehicle dealer is required to disclose in a clear and conspicuous manner on any contract for the sale of a motor vehicle to a retail consumer each of the following: 1) whether or not the transaction is subject to a fee received by a broker from the selling motor vehicle dealer; and 2) the name of the broker, if applicable (A.R.S. § 28-4417).
Current statute prohibits motor vehicle dealers from advertising or offering for sale or exchange any specific motor vehicle unless: 1) the motor vehicle is for sale and located at the motor vehicle dealer's established place of business; 2) the motor vehicle dealer discloses in the advertisement the specific street address and business hours where the motor vehicle may be inspected by a retail customer; or 3) the motor vehicle is available to the motor vehicle dealer directly from the manufacturer or distributor of the motor vehicle at the time of the advertisement or offer (A.R.S. § 28-4415).
A motor vehicle dealer is defined as a new motor vehicle dealer, used motor vehicle dealer, public consignment auction dealer, broker or wholesale motor vehicle auction dealer, excluding a person who comes into possession of a motor vehicle as an incident to the person's regular business and who sells, auctions or exchanges the motor vehicle (A.R.S. § 28-4301).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Requires a motor vehicle dealer, who charges a document fee for motor vehicle transactions, to clearly and conspicuously disclose in the advertisement for a motor vehicle that a document fee will be charged for the motor vehicle transaction.
2. Makes a technical change.
3. Becomes effective on the general effective date.
