ARIZONA STATE SENATE

election deadlines; modifications prohibited
Purpose
Prohibits an officer or agent of the state, a political subdivision or other governmental agency from modifying a statutory election deadline or date and classifies a violation as a class 6 felony.
Background
Statute outlines numerous election dates and deadlines, including voter registration deadlines, early voting timelines, the dates that early ballots may be requested and mailed and the deadline for candidates to file nomination papers and petitions (Title 16, Arizona Revised Statutes). Elections requirements may be enforced through civil and criminal action by the Attorney General or a county, city or town attorney, depending on the offices included in the election (A.R.S. § 16-1021).
There is no anticipated fiscal impact to the state General Fund associated with this legislation.
Provisions
1. Prohibits an officer or agent of the state, a political subdivision or other governmental agency, unless prescribed by a court of competent jurisdiction, from modifying or agreeing to modify any deadline, filing date, submittal date or other statutory election-related date.
2. Classifies, as a class 6 felony, modifying any deadline, filing date, submittal date or other statutory election date.
3. Becomes effective on the general effective date.
