AN ACT
amending title 28, chapter 20, article 5, Arizona Revised Statutes, by adding section 28‑7060; relating to state highways.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 28, chapter 20, article 5, Arizona Revised Statutes, is amended by adding section 28-7060, to read:
28-7060. New state highway placement decisions; environmental impact statement; state highway alignment; public comments process
Notwithstanding any other law, when issuing a final tier 1 environmental impact statement and record of decision for a new state highway in a county with a population of more than four hundred thousand persons and less than eight hundred thousand persons, the department shall:
1. Ensure the selection of a state highway alignment that services the most populous geographical area with the greatest potential for economic development based on data related to the anticipated opening date of the state highway.
2. Prioritize the majority opinion of feedback received from impacted citizens, local JURISDICTIONS and stakeholders during the public comments process as a factor of consideration in the issuance of the final statement and record of decision.
