AN ACT

 

relating to education finance for fiscal years 2020-2021 and 2021-2022.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Public schools; funding; fiscal years 2020-2021 and 2021-2022

A. Notwithstanding section 15-185, subsection B, paragraph 1, Arizona Revised Statutes, and section 15-943, Arizona Revised Statutes, for the purposes of computing base support level funding for fiscal year 2020-2021, the weighted student count for a school district or charter school pursuant to section 15-943, paragraph 2, Arizona Revised Statutes, is the greater of:

1. The weighted student count computed for fiscal year 2018-2019.

2. The weighted student count computed for fiscal year 2019-2020.

3. The weighted student count computed for fiscal year 2020-2021.

B. Notwithstanding section 15-185, subsection B, paragraph 1, Arizona Revised Statutes, and section 15-943, Arizona Revised Statutes, for the purposes of computing base support level funding for fiscal year 2021-2022, the weighted student count for a school district or charter school pursuant to section 15-943, paragraph 2, Arizona Revised Statutes, is the greater of:

1. The weighted student count computed for fiscal year 2018-2019.

2. The weighted student count computed for fiscal year 2019-2020.

3. The weighted student count computed for fiscal year 2020-2021.

4. The weighted student count computed for fiscal year 2021-2022.

C. Notwithstanding section 15-943.02, Arizona Revised Statutes, for the purposes of computing base support level funding for fiscal year 2020-2021, the weighted student count for a career technical education district pursuant to section 15-943.02, subsection A, Arizona Revised Statutes, is the greater of:

1. The weighted student count computed for fiscal year 2018-2019.

2. The weighted student count computed for fiscal year 2019-2020.

3. The weighted student count computed for fiscal year 2020-2021.

D. Notwithstanding section 15-943.02, Arizona Revised Statutes, for the purposes of computing base support level funding for fiscal year 2021-2022, the weighted student count for a career technical education district pursuant to section 15-943.02, subsection A, Arizona Revised Statutes, is the greater of:

1. The weighted student count computed for fiscal year 2018-2019.

2. The weighted student count computed for fiscal year 2019-2020.

3. The weighted student count computed for fiscal year 2020-2021.

4. The weighted student count computed for fiscal year 2021-2022.

E. Notwithstanding section 15-185, Arizona Revised Statutes, for fiscal year 2020-2021, the amounts for charter additional assistance prescribed in section 15-185, Arizona Revised Statutes, shall be computed using the greater of:

1. The student count for fiscal year 2018-2019.

2. The student count for fiscal year 2019-2020.

3. The student count for fiscal year 2020-2021.

F. Notwithstanding section 15-185, Arizona Revised Statutes, for fiscal year 2021-2022, the amounts for charter additional assistance prescribed in section 15-185, Arizona Revised Statutes, shall be computed using the greater of:

1. The student count for fiscal year 2018-2019.

2. The student count for fiscal year 2019-2020.

3. The student count for fiscal year 2020-2021.

4. The student count for fiscal year 2021-2022.

G. Notwithstanding section 15-961, Arizona Revised Statutes, for fiscal year 2020-2021, the amounts for district additional assistance prescribed in section 15-961, Arizona Revised Statutes, shall be computed using the greater of:

1. The student count for fiscal year 2018-2019.

2. The student count for fiscal year 2019-2020.

H. Notwithstanding section 15-961, Arizona Revised Statutes, for fiscal year 2021-2022, the amounts for district additional assistance prescribed in section 15-961, Arizona Revised Statutes, shall be computed using the greater of:

1. The student count for fiscal year 2018-2019.

2. The student count for fiscal year 2019-2020.

3. The student count for fiscal year 2020-2021.

I. Notwithstanding Executive Orders 2020-41 and 2020-51 and any other law, for fiscal year 2020-2021, students who receive instruction through a distance learning plan submitted pursuant to Executive Order 2020-41:

1. Shall be funded at the same amount as students receiving in-person instruction under title 15, chapter 9, Arizona Revised Statutes.

2. May not be funded as students receiving Arizona online instruction under section 15-808, Arizona Revised Statutes.

Sec. 2. Retroactivity

This act applies retroactively to from and after June 30, 2020.

Sec. 3. Emergency

This act is an emergency measure that is necessary to preserve the public peace, health or safety and is operative immediately as provided by law.
