FLOOR AMENDMENT EXPLANATION

 

1.   Specifies that the Office of Administrative Hearings does not have original jurisdiction over matters relating to the statutes governing video service that arise under the constitution, laws or treaties of the United States, including the Communications Act of 1934 and all other applicable federal law.

2.   Allows a complaint regarding video service to be brought before the Federal Communications Commission or a federal court of competent jurisdiction, if a matter arises under the constitution, laws or treaties of the United States.

Page 1, line 9, after the period insert "unless the matter arises under the constitution, laws, or treaties of the United States, including the communications act of 1934 (P.L. 73-416; 47 united states code sections 151 through 615b) and all other applicable federal law,"

Line 13, after "1." insert "to the extent allowed by federal law,"

Line 14, after the period insert "if a matter arises under the constitution, laws, or treaties of the United States, the COMPLAINT may be brought before the federal communications commission or a federal court of competent jurisdiction."

Page 2, line 44, after the period insert "unless the matter arises under the constitution, laws, or treaties of the United States, including the communications act of 1934 (P.L. 73-416; 47 united states code sections 151 through 615b) and all other applicable federal law,"
