AN ACT
amending title 37, chapter 9, Arizona Revised Statutes, by adding article 2; amending title 40, chapter 2, article 1, Arizona Revised Statutes, by adding SECTION 40-213; relating to biomass.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 37, chapter 9, Arizona Revised Statutes, is amended by adding article 2, to read:
ARTICLE 2. BIOMASS ENERGY PROVIDERS
37-1341. Biomass energy providers; definition
A. NOtwithstanding any other law, the Arizona department of forestry and fire management shall regulate biomass energy PROVIDErs in a manner as determined by the state forester by rule.
B. For the purposes of this section, "biomass" has the same meaning prescribed in section 3-3401.
Sec. 2. Title 40, chapter 2, article 1, Arizona Revised Statutes, is amended by adding section 40-213, to read:
40-213. Biomass energy provider; exception; definition
A. NOtwithstanding any other law, biomass energy PROVIDErs ARE NOT PUBLIC service corporations UNDER ARTICLE XV, SECTION 2, CONSTITUTION OF ARIZONA, AND ARE NOT SUBJECT TO THIS CHAPTER.
B. For the purposes of this section, "biomass" has the same meaning prescribed in section 3-3401.
