AN ACT
amending Title 8, chapter 4, article 8, Arizona Revised Statutes, by adding section 8-820; relating to the department of child safety.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Title 8, chapter 4, article 8, Arizona Revised Statutes, is amended by adding section 8-820, to read:
8-820. Investigation; schools; children with disabilities; definitions
A. A child safety worker or a child safety investigator may enter a school that teaches a child with a disability to investigate a report of abuse of such a child at the school.
B. For the purposes of this section:
1. "Child" means either of the following:
(a) An individual who is under eighteen years of age.
(b) An individual who is at least eighteen years of age and under twenty-three years of age and who is enrolled in high school.
2. "child with a disability" means a child who is any of the following:
(a) Identified as having a disability under section 504 of the rehabilitation act of 1973 (P.L. 93-112; 87 Stat 355; 29 United States Code section 794).
(b) Identified by a school district or by an independent third party pursuant to section 15-2403, subsection I as a child with a disability as defined in section 15-731 or 15-761.
(c) A child with a disability who is eligible to receive services from a school district under section 15-763.
(d) A child with a disability as defined in 42 United States code section 12102.
