AN ACT

Amending title 23, chapter 10, article 1, Arizona Revised Statutes, by adding section 23-1605; relating to employment status.

Be it enacted by the Legislature of the State of Arizona:

Section 1. Title 23, chapter 10, article 1, Arizona Revised Statutes, is amended by adding section 23-1605, to read:

START_STATUTE23-1605. Motor carriers; employment status; safety improvement; definitions

A. A motor carrier's use of safety improvement may not be considered when evaluating a person's status as an employee or independent contractor.

B. For the purposes of this section:

1. "Motor carrier" has the same meaning prescribed in section 28-5201.

2. "Safety improvement" means any device, equipment, software, technology, procedure, training, policy, program or operational practice intended and primarily used to improve or facilitate any of the following:

(a) Compliance with traffic safety or motor carrier safety laws.

(b) Safety of a motor vehicle.

(c) Safety of the operation of a motor vehicle.

(d) Safety of third-party users of a public highway as defined in section 28-5201. END_STATUTE
