AN ACT
Establishing a Corporation commission study on a community choice aggregation pilot program; appropriating monies.

Be it enacted by the Legislature of the State of Arizona:
Section 1. Corporation commission; study on community choice aggregation pilot program; investor-owned electric utilities; report; delayed repeal
A. The corporation commission shall open a docket to study a potential community choice aggregation pilot program within the service areas of investor-owned electric utilities in this state. The corporation commission shall study a potential pilot program that would allow persons within a community choice aggregation pilot program to opt back in to electric service provided by their previous investor-owned electric utility. The corporation commission may accept testimony and documentation from all of the following to assist in its study and determination:
1. Local governments with declared goals relating to carbon emissions or energy supply choices.
2. Business groups.
3. Environmental advocates.
4. Consumer advocates.
5. Electric utilities, including investor-owned electric utilities, municipally owned electric utilities and cooperative electric associations.
6. Independent power producers.
7. Renewable energy developers.
8. Consultants or other experts in energy project financing.
9. Consultants or other experts in energy efficiency and distributed energy resources.
10. Representatives of operational community choice aggregation authorities.
11. Members of the public.
B. The corporation commission shall determine all of the following:
1. The best options to conduct a community choice aggregation pilot program, including ideal locations and best practices.
2. What legal, monetary and practical hurdles may block the implementation of a community choice aggregation pilot program.
3. What is necessary to ensure a community choice aggregation pilot program provides sustainable, affordable and reliable electric service.
4. What is necessary to ensure a community choice aggregation pilot program contains sufficient consumer protections and does not harm consumers who are served by an investor-owned electric utility.
5. The degree to which a community choice aggregation pilot program may accelerate the transition to clean energy in this state.
C. On or before November 1, 2023, the commission shall submit a report of its findings and recommendations to the governor, the president of the senate and the speaker of the house of representatives and shall provide a copy of this report to the secretary of state.
D. This section is repealed from and after December 31, 2023.
Sec. 2. Appropriation; corporation commission; community choice aggregation pilot program
The sum of $1,000,000 is appropriated from the state general fund in fiscal year 2022-2023 to the corporation commission for the corporation commission's study of a community choice aggregation pilot program within the service areas of investor-owned electric utilities in this state.
