The bill would make technical changes to A.R.S. § 15-393 relating to Career Technical Education Districts (CTEDs).
Estimated Impact
The bill has no anticipated fiscal impact.
During the 2021 session, there were 3 session laws (Chapters 252, 404, and 416) that amended A.R.S. § 15-393 relating to CTEDs. According to Legislative Council, the 3 session laws could not be blended into a single statute due to incompatible language relating to the timeframe for counting of CTED average daily membership (ADM) for the purposes of Basic State Aid calculations. As a result, in blending the 3 session laws pursuant to A.R.S. § 41-1304.03, Legislative Council established 2 different sections of A.R.S. § 15-393. One section includes the changes associated with Chapters 252 and 416, while the other includes the changes associated with Chapters 252 and 404.
The bill would blend the 2 existing sections of A.R.S. § 15-393 into a single statute by adopting the language relating to the timeframe for counting of CTED ADM from Chapter 416. According to Legislative Council, the Chapter 416 language is already operative, and does not directly conflict with the language from Chapter 404. As a result, we do not think the bill results in a fiscal impact.
We have asked the Department of Education for their analysis of the impact of the bill.
