HOUSE OF REPRESENTATIVES AMENDMENTS TO H.B. 2486

Strike everything after the enacting clause and insert:
"Section 1. Department of health services; health care costs; report; delayed repeal; definitions
A. The department of health services shall issue a report that aggregates all publicly available health care cost data and that investigates the extent to which a variation may exist in the amounts that hospitals charge to insurers. The report shall include all of the following:
1. The average amount allowed by major insurance carriers for comparable health care services based on an aggregation of the most common services provided.
2. A comparison of charged amounts insurers agreed to pay between major hospital systems.
3. The concentration of health care providers in this state to determine whether the market is anticompetitive.
4. Any disproportionate impact of the variation in commercial health care hospital rates based on:
(a) Race.
(b) Gender.
(c) Income.
(d) Any other relevant demographic indicator.
B. On or before January 1, 2023, the department shall submit the report of its findings and recommendations to the governor, the president of the senate and the speaker of the house of representatives and shall provide a copy of this report to the secretary of state.
C. This section is repealed from and after June 30, 2023.
D. For the purposes of this section:
1. "Amount allowed" means the contractually agreed on amount paid by an insurance carrier to a health care entity participating in the carrier's network.
2. "Average" means median, mean or mode paid to a network provider for a procedure or service that is paid within a reasonable time frame not to exceed one year.
3. "Comparable health care service" means any covered nonemergency health care service or bundle of services."
