SENATE AMENDMENTS TO S.B. 1191

Strike everything after the enacting clause and insert:
"Section 1. Title 12, chapter 1, article 2, Arizona Revised Statutes, is amended by adding section 12-137, to read:
12-137. Virtual court appearance; court rule
A. Before October 1, 2022, the supreme court shall adopt and make effective rules to allow parties, including attorneys and witnesses, to participate in civil proceedings remotely by using a telephone or video conference connection.
B. court rules adopted pursuant to subsection A of this section shall presumptively allow for remote participation in the proceeding unless the supreme court adopts a rule that remote participation is not practical for a particular case type or proceeding type or otherwise in the interest of justice."
