Overview

Expands Supplemental Nutrition Assistance Program (SNAP) eligibility to individuals with felony drug convictions. Requires specified individuals who are eligible for SNAP to comply with probation conditions.

History

For individuals with a felony offense involving the possession or use of a controlled substance, eligibility for SNAP requires a conviction date after August 22, 1996 (A.R.S. § 46-219).  

Currently, specified individuals may be eligible for SNAP if they meet at least one of the following:

1)   Successful completion or participation in a substance abuse treatment program;

2)   Acceptance or enrollment in a substance abuse treatment program;

3)   An individual is determined by a licensed medical provider not to need substance abuse treatment; or

4)   Comply with all terms of probation, as applicable.

SNAP eligibility may include frequent drug testing for offenses that occurred within 24 months of an individual's date of application (A.R.S. § 46-219).

Provisions

1.   Removes SNAP eligibility requirement that a person must agree to random drug testing. (Sec. 1)

2.   Changes SNAP eligibility requirement from an individual with a felony drug conviction after August 22, 1996, to include any individual convicted with the specified offense. (Sec. 1)

3.   Removes the following from SNAP eligibility requirements:

a)   Successful completion or participation in a substance abuse treatment program;

b)   Acceptance or enrollment in a substance abuse treatment program; or

c)   An individual is determined by a licensed medical provider not to need substance abuse treatment. (Sec. 1)

4.   Removes the requirement that SNAP eligibility include frequent drug testing for offenses that occurred within 24 months of an individual's date of application. (Sec. 1)

5.   Mandates specified individuals comply with all terms of probation, including any drug testing, as applicable, to be eligible for SNAP. (Sec. 1)
