Overview

Modifies the time period by which certain provisions apply to a Public Safety Personnel Retirement System (PSPRS) or Corrections Officer Retirement Plan (CORP) member who retires and becomes reemployed by the same employer.

History

Statute outlines various scenarios that apply for a retired PSPRS and CORP member who becomes reemployed in any capacity by the employer from which the member retired before 12 months after the date of retirement or in the same position at any time following retirement.  For example, any pension payments that are received by the retired member, who retired on or after July 1, 2009, during the period of reemployment are considered overpayments.  If the board determines that the retired member's reemployment during the 12-month period and the failure of the employer to suspend the member's pension were not intentional to circumvent the requirements, the pension payments received are subject to repayment. The pension payments received after the retired member’s reemployment are subject to repayment up to only the amount received between the reemployment date and the expiration of the 12-month period. (A.R.S. §§ 38-849, 38-884).

Provisions

1.   Stipulates that a retired member may become employed by the same employer from which the employee retired in a designated position and continue to receive a pension if the employment occurs at least six months, rather than 12 months, after retirement. (Sec. 1, 2)

2.   Specifies that certain overpayments after becoming reemployed do not apply if the retired PSPRS member has a prearranged reemployment agreement with the employer. (Sec. 1)

3.   Makes technical and conforming changes. (Sec. 1, 2)
