HB2379: election procedures manual; statutory conflict

Requires the Elections Procedures Manual (manual) to provide for transparency and election security.
History
Statute explains that the Secretary of State prescribes the manual which outlines rules to achieve and maintain the maximum degree of correctness, impartiality, uniformity and efficiency on the procedures for early voting and voting and of producing, distributing, collecting, counting, tabulating and storing ballots (A.R.S. § 16-452).
Electronic voting system means a system in which votes are recorded on a paper ballot by means of marking, and such votes are subsequently counted and tabulated by voting tabulating equipment at one or more counting centers (A.R.S. § 16-444).
Provisions
1. Requires the manual to provide for transparency and election security to the maximum extent allowed by law. (Sec. 1)
2. Asserts that if any provision of the manual conflicts with statute, the manual is unenforceable, and the statute prevails. (Sec. 1)
3. Includes the Legislature in the requirement to provide experts in electronic voting systems to field check and review electronic voting systems. (Sec. 1)
4. Adds the manual in the requirement of the electronic voting system experts to make recommendations of necessary changes to the manual. (Sec. 1)
5. Makes conforming changes. (Sec. 1)
