Overview

Makes revisions to transportation statutes relating to the Arizona Department of Transportation (ADOT), driver's licenses, Vehicle License Tax (VLT) requirements, and aircraft and fleet registration requirements.

History

Laws 1973, Chapter 146 established the ADOT to provide for an integrated and balanced state transportation system with a director responsible for the department's administration (A.R.S. § 28-331). ADOT has exclusive control and jurisdiction over state highways, state routes, state-owned airports and all state-owned transportation systems or modes are vested in ADOT.

The duties of ADOT are as follows: 1) register motor vehicles and aircraft, license drivers, collect revenues, enforce motor vehicle and aviation statutes and perform related functions; 2) do multimodal state transportation planning, cooperate and coordinate transportation planning with local governments and establish an annually updated priority program of capital improvements for all transportation modes; 3) design and construct transportation facilities in accordance with a priority plan and maintain and operate state highways, state-owned airports and state public transportation systems; 4) investigate new transportation systems and cooperate with and advise local governments concerning the development and operation of public transit systems; and 5) have administrative jurisdiction of transportation safety programs and implement them in accordance with applicable law (A.R.S. § 28-332).

Provisions

1.   Removes requirement for an applicant of a class A, B, or C license to only have 3 attempts to pass the written examination within twelve months. (Sec. 1)

3.   Extends the amount of time a permittee can operate a class A, B, or C license from six to twelve months. (Sec. 3)

4.   Removes requirement for ADOT to publish ownership transfer of an abandoned vehicle in a newspaper and requires ADOT to publish the transfer on their website for at least thirty days.  (Sec. 6)

5.   Requires the owner of an impounded vehicle to show proof that their driving privileges have been restored in order to pick up a vehicle. (Sec. 6)H

6.   Increases the weight for an all-terrain or off-highway vehicle to qualify for a 3-dollar VLT from 1,800 pounds to 2,500 pounds. (Sec. 7)

7.   States that the minimum VLT for alternative use vehicles is ten dollars. (Sec. 8)

8.   Requires the auditor general to report to the State Treasurer instead of ADOT after conducting a performance review. (Sec. 9)

9.   Removes requirement to register a hot air balloon with ADOT. (Sec. 10)

10.  Requires ADOT to establish a system of staggered registration on a monthly basis to distribute the work of registering aircraft as uniformly as possible.

11.  Requires ADOT to charge a prorate a license tax that is one-twelfth of the full annual amount if the staggered system results in the expiration of any registration more than a year after it is issued. (Sec. 11)

12.  Allows the Director ADOT to register an aircraft for more or less than a twelve-month period but not more than an eighteen-month period. (Sec. 11)

13.  Specifies requirements for the Director of ADOT to approve requests for fleet applications thirty days before the registration date. (Sec. 11)
