Overview
Removes the forcible entry and detainer filing fee for a defendant.
History
Civil action fees are fees given to Justices of the Peace for certain civil actions. Justices of the Peace must transmit monies collected from civil action fees to the county treasurer for distribution into specified funds. No monies are deposited into the state General Fund. The Supreme Court may raise the fees by an amount not greater than the average percent change of the U.S. Consumer Price Index between the amount in the latest calendar year and the calendar year in which the last fee increase occurred. There is currently a base amount of $18 for a forcible entry and detainer filing fee for a defendant (A.R.S. 22-281).
Provisions
1. Removes the forcible entry and detainer filing fee for a defendant from the list of established civil action fees. (Sec. 2)
2. Prohibits a court from either imposing or collecting a fee for filing an answer to a complaint for forcible entry or detainer. (Sec. 1)
