HB 2580: wildfire management; delegation of authority

Overview
Requires the State Forester to maintain copies of all delegation of authority agreements this state enters into with the federal government.
History
The State Forester is appointed by the Governor to lead the Department of Forestry and Fire Management (DFFM). In that capacity, this official can enter into delegation of authority agreements with the federal government when wildfires occur (A.R.S. §§ 37-1301 and 37-1302). These agreements delegate authority and assign responsibility from a state agency executive to a fire incident commander and can include objectives, priorities, considerations and guidance related to cost constraints and jurisdiction.
The Arizona State Library, Archives and Public Records sets retention schedules for state agency documents (A.R.S. § 41-151.12). According to DFFM's current records retention schedule, delegations of authority are considered permanent records, which means that they are transferred to the State Archives once their administrative value has been served. Permanent records cannot be destroyed (A.R.S. § 39-101).
Provisions
1. Directs the State Forester to:
a) Perform all management and administrative functions delegated to Arizona by the United States relating to wildfire prevention, mitigation and suppression activities; and
b) Obtain and maintain copies of delegation of authority agreements entered into with the United States. (Sec. 1)
