Overview

Requires the Arizona Health Care Cost Containment System (AHCCCS) or their designee to annually renew the eligibility of a person who is determined eligible without requiring more information from them until they're 26 years old and outlines exceptions.

History

A.R.S. § 36-2901 outlines eligibility for AHCCCS. Specifically, an individual who is under the age of 26 and was in the custody of the Department of Child Safety (DCS) when they turned 18 is eligible for AHCCCS coverage. AHCCCS will determine the eligibility of the individual and redetermine their eligibility on an annual basis (A.R.S. § 36-2903.04).

The Arizona Administrative Code states that AHCCCS or its designee must renew eligibility without requiring information from the individual if able to do so based on reliable information available to the agency, including through an electronic data match. If able to renew eligibility based on such information, AHCCCS or its designee must send the member notice of: 1) the eligibility determination; and 2) the member's requirement to notify AHCCCS or its designee if any of the information contained in the renewal notice is inaccurate (A.A.C. R9-22-306).

Provisions

1.   Requires AHCCCS or its designee, subject to the approval of the Centers for Medicare and Medicaid Services, to annually renew the eligibility of a person under 26 years of age and who was in the custody of DCS when the person turned 18 without requiring additional information from the person until the age of 26, unless the individual:

a)   Notifies AHCCCS that the person moved out of state; or

b)   Provides information to AHCCCS indicating that the person may qualify for a different eligibility category. (Sec. 1)

2.   Allows AHCCCS or its designee to use reliable information, including an electronic data match, to determine state residency during the person's eligibility period. (Sec. 1)

Senate Amendments

1.   Specifies that AHCCCS or its designee, upon CMS approval, will annually renew on an automatic basis the eligibility of a person under the DCS eligibility category, without requiring additional information from them until the age of 26, unless the person notifies AHCCCS that they either:

a)   Moved out of Arizona; or

b)   May qualify for a different eligibility category.

2.   States that if a person's eligibility in a different eligibility category ends, AHCCCS must automatically transfer that person back to the DCS eligibility category without disruption in medical coverage.
