The House Engrossed version of HB 2635 directs health care employers to develop, implement and maintain a written workplace violence prevention plan.

The Senate adopted a strike-everything amendment that does the following:

Overview

Applies statutory informed consent requirements for cosmetic breast implant surgery to breast implant surgery for reconstructive purposes.

History

Before performing breast implant surgery, a licensed medical doctor or osteopathic physician must provide patients in writing or in an electronic format the following information:

1)   A description of the risks of breast implants and the surgical procedures used in breast implant surgery;

2)   Manufacturer patient information materials either in a hard copy or an electronic format on the implants that will be used in surgery, including warning requirements prescribed by the U.S. Food and Drug Administration (USFDA);

3)   The informed consent checklist, including information on breast implant-associated anaplastic large cell lymphoma, breast implant illness and the National Breast Implant Registry; and

4)   Information on how the patient can report adverse events associated with breast implants through the USFDA MedWatch program or any similar program.

Physician must provide this information and obtain written informed consent prior to surgery. A physician who knowingly violates these informed consent requirements commits an act of unprofessional conduct and is subject to disciplinary action.

Breast implant surgery means the surgical placement of a cosmetic breast implant (A.R.S. § 32-3228).
