Overview

Prohibits businesses operating in Arizona from selling goods that were made with forced labor or slave labor.

Provisions

1.   ☐ Prop 105 (45 votes)	     ☐ Prop 108 (40 votes)      ☐ Emergency (40 votes)	☐ Fiscal NoteProhibits a business entity from selling goods in Arizona or to Arizonans through electronic means if the goods were manufactured using forced labor or slave labor. (Sec. 1)

2.   Requires a corporate officer to annually sign and file an attestation under the penalty of perjury with the Attorney General by the end of each January stating that the goods to be sold are not the result of forced labor or slave labor. (Sec. 1)

3.   Limits the extension of the attestation filing period to 30 days. (Sec. 1)

4.   Directs the Attorney General to investigate violations. (Sec. 1)

Amendments

Committee on Commerce

1.   Adds the prohibition and attestation requirements apply to businesses and the business's third-party vendors that sell products online or at a physical location and that:

a)   Have gross receipts of at least $25,000,000; and

b)   Import products from other countries or enter into labor contracts or employ persons outside of the U.S.

2.   Removes the requirement for the Attorney General to investigate violations.
