HB 2811: unlawful abortion medication; offense

Overview
Makes the manufacturing, distribution, prescribing or transferring of an abortion medication intended to cause an abortion a class 3 felony.
History
An abortion-inducing drug may only be provided by a qualified physician. A manufacturer, supplier, physician or any other person is prohibited from providing an abortion-inducing drug via courier, delivery or mail service.
Abortion-inducing drug means medicine or drug or any other substance used for a medication abortion (A.R.S. § 36-2160).
Provisions
1. States it is unlawful for a person or entity to manufacture, distribute, prescribe, sell or transfer an abortion medication that is intended to cause an abortion. (Sec. 1)
2. Establishes a penalty of a class 3 felony for a violation of the above provision. (Sec. 1)
3. Exempts from a class 3 felony penalty the following:
a) The mother of the child; and
b) The sale, use or administering of any contraceptive agent before conception or before conception can be confirmed through conventional medical testing. (Sec. 1)
4. Defines abortion medication. (Sec. 1)
5. Instructs legislative council staff to prepare conforming legislation. (Sec. 2)
