Overview
Repeals session law relating to the 2022 election for political party precinct committeemen and establishes, as session law, the procedures for candidates for election in 2022 to the office of precinct committeeman.
History
Laws 2022, Chapter 3, § 4 prescribes, as session law, the process for the 2022 election for political party precinct committeemen. Candidates are required to submit to their county political party committee (Committee) a nomination paper or other similar written statement of candidacy no later than April 18, 2022 and are not required to submit a nomination petition or file other documents with a filing officer. The Committee must then verify the potential candidate's eligibility based on the April 1 voter registration totals prescribed in statute. No later than May 2, 2022, the Committee is required to submit to the county board of supervisors (BOS) one precinct committeeman candidate's name for each election precinct in the county for appointment. The Committee is the sole determiner of the single political party precinct committeeman candidate whose name is submitted. The BOS is directed to appoint the political party precinct committeemen from the submitted names and those appointed for the 2022 term of office are deemed elected precinct committeemen for all purposes.
For any vacancies in the office of precinct committeeman that occur during the 2022 term of office, the Committee must appoint eligible people to fill the vacancies and maintain a current roster of precinct committeemen for the remainder of the 2022 term, and no further action regarding vacancies is required by the BOS.
Provisions
1. Repeals session law relating to the 2022 election cycle and the process for the election of political party precinct committeemen. (Sec. 1)
2. Stipulates that, for candidates for election in 2022 to the office of precinct committeeman after redistricting, the following apply:
a) If the candidate's nomination paper and petition comply with the law, the filing officer must accept as a valid filing the nomination paper and petition of a person that designate the candidate's election precinct, without regard to any designation of legislative district number, and that use either or both:
i. The candidate's election precinct as used in the election for that office immediately before redistricting.
ii. The candidate's election precinct as designated by the county board of supervisors as a result of or after the adopted redistricting plan for the upcoming election.
b) If the candidate's nomination paper and petition comply with the law, the filing officer must accept and petition signers are valid if the petition signers are qualified signers and residents of either or both of the following election precincts that the candidate proposes to represent without regard to any designation of legislative district number:
i. The candidate's election precinct as used in the election for that office immediately before redistricting.
ii. The candidate's election precinct as designated by the county board of supervisors as a result of or after the adopted redistricting plan for the upcoming election.
c) The number of signatures required for the candidate's nomination petition is the lesser of the following:
i. The number of qualified signers as prescribed by statute that is based on the candidate's election precinct as used in the election for that office immediately before redistricting.
ii. The number of qualified signers as prescribed by statute that is based on the candidate's election precinct as designated by the county board of supervisors as a result of or after the adopted redistricting plan for the upcoming election.
d) The candidate must file the nomination paper and petition no later than April 4, 2022. (Sec. 2)
3. Directs the county board of supervisors, for the 2022 election for precinct committeemen, to determine the number of precinct committeemen for each election precinct as prescribed by statute, based on the number of registered voters in the party in the precinct on the day election precinct boundaries become available in the voter information database but no later than March 21, 2022. (Sec. 2)
4. Specifies that the following apply for any 2022 candidate for precinct committeeman who files with that candidate's political party committee as prescribed by Laws 2022, Ch. 3, § 4 while in effect and if the candidate is in compliance with otherwise applicable law:
a) The candidate's filing is valid.
b) No later than April 4, 2022, the chair of the county political party committee must forward the names and candidate information of all precinct committeeman candidates, to the county officer in charge of elections, who have filed with the county political party committee. (Sec. 2)
5. Contains a retroactivity clause of March 3, 2022. (Sec. 3)
6. Contains an emergency clause. (Sec. 4)
