Overview

Expresses the Legislature's support of the United States Congress to pass the Good Samaritan Remediation of Abandoned Hardrock Mines Act.

History

On February 3, 2022, United States Senator Heinrich from New Mexico introduced Senate bill 3571, also known as the Good Samaritan Remediation of Abandoned Hardrock Mines Act (Act). The Act would authorize the Environmental Protection Agency Administrator to establish a pilot program to remediate historic mine residue at qualified abandoned mine sites. This official would issue 15 permits to carry out remediation efforts. The Good Samaritan entities that can use these permits are not the past or current owner or operators of the mine site, had no role in creating the historic mine residue, and is not potential liable under federal, state, tribal or local law for the remediation, treatment or control of historic mine residue (S. 3571).

Provisions

1.   Declares that members of the Legislature support the United State Congress in passing the Act.

2.   Directs the Secretary of the State of Arizona to transmit a copy of this Resolution to the President of the United States Senate, the Speaker of the United States House of Representatives☐ Prop 105 (45 votes)	     ☐ Prop 108 (40 votes)      ☐ Emergency (40 votes)	☐ Fiscal Note and each member of Congress from the State of Arizona.
