Overview

Clarifies statute relating to the neglect of a child.

History

Current statute defines neglect of a child or neglected as: 1) a guardian's inability or unwillingness to provide a child with care that causes an unreasonable risk of harm to the child; 2) allowing a child to enter or remain in any structure in which volatile chemicals or dangerous drugs are found; 3) a determination by a health professional that an infant was exposed prenatally to an illegal substance; 4) diagnosis of fetal alcohol syndrome or fetal alcohol effects by a health professional of an infant under one year of age; 5) deliberate exposure of a child to sexual conduct, sexual contact or explicit sexual materials by a guardian; or 6) any sexual offense acts committed by a guardian with reckless disregard as to whether a child is physically present (A.R.S. § 8-201).

The penalty for child abuse ranges from a class 2 to class 4 felony (A.R.S. § 13-3623).
