SB 1074: dentists; scope of practice

Overview

Expands the practice of dentistry to include the administering of botulinum toxin type A (Botox) and dermal fillers for therapeutic or cosmetic purposes.

History

Current law outlines the practice of dentistry as the diagnosis, surgical or nonsurgical treatment and performance of related adjunctive procedures for any disease, pain, deformity, deficiency, injury or physical condition of the human tooth or teeth, alveolar process, gums, lips, cheek, jaws, oral activity and associated tissues, including the removal of stains, discolorations and concretions (A.R.S. § 32-1202).

Statute outlines acts that constitute unprofessional conduct in the dentistry profession which includes the prescribing, dispensing or usage of drugs for other than accepted dental therapeutic purposes or for other than medically indicated supportive therapy in conjunction with managing a patient's dental needs (A.R.S. § 32-1201.01).

A sunrise application was submitted November 1, 2021, requesting an expansion to the scope of practice for the profession of dentistry to allow dentists to administer Botox and dermal fillers to patients in need of both therapeutic and cosmetic services.

Provisions

1.   Specifies that the practice of dentistry includes the diagnosis, surgical or non-surgical treatment and performance of related adjunctive procedures for any disease, pain, deformity, deficiency, injury or physical condition of associated tissues of the oral maxillofacial complex. (Sec. 2)

2.   Adds the administering of Botox and dermal fillers to the oral maxillofacial complex for therapeutic or cosmetic purposes to the practice of dentistry. (Sec. 2)

3.   Deems the act of prescribing, dispensing or using drugs for other than accepted dental therapeutic purposes or medically indicated supportive therapy in conjunction with managing the patients' needs and within the scope of practice of dentistry as unprofessional conduct. (Sec. 1)
